[LEGAL UPDATE DECEMBER 2024] DECREE 118/2024/ND-CP 

1. Regulations on regimes for prisoners: 

• Labor regime and remuneration: Prisoners are paid labor wages according to quarterly grading periods, with 10% of labor results used for payment. The remaining amount will be deducted according to the prescribed percentage to other amounts such as: 14% to supplement food rations, 02% to the community integration fund, and 02% to support when occupational accidents... 

• Living Regime: Specific regulations on clothing, personal belongings, and diet of prisoners, in accordance with weather and local conditions, for example, the provision of quilts to prisoners in the North and Central Highlands. 

2. Classification of imprisonment sentences: 

• Classification includes criteria such as labor performance, vocational training, attitude toward rehabilitation, and compliance with prison regulations. Periodic evaluations influence the potential reduction of sentence duration. 

3. Asset Management and Reintegration Support: 

• The Decree requires the establishment of funds to support the reintegration of prisoners after serving their sentences, the organization of vocational training and cultural programs, and the assurance of medical and welfare support. 

4. Application of disciplinary forms: 

• The Decree stipulates that violators with one of the following circumstances may be considered for mitigating disciplinary measures: First-time violations, causing minor consequences; to make sincere and truthful declarations about their violations and those of other inmates; proactively prevent violations of other prisoners; actively overcome the consequences caused by them (if any)... 

• For aggravating circumstances, inmates who commit one or more of the following circumstances must consider aggravating disciplinary forms: Organized violations, being the masterminds, leaders, initiators or actively and directly committing violations; directing, threatening, coercing, coercing, enticing, inciting other prisoners to violate... 

Decree No. 118/2024/ND-CP represents a balanced approach, combining strict management by competent authorities with humane measures aimed at educating and supporting social reintegration. It provides inmates with opportunities for self-improvement during their sentences while preparing them to become productive citizens upon re-entering society.
